The City Council has complied with a court order that requires it to respect the property titles over 3.9 kilometers (2.4 miles) of the coastal road.
However, it ensures that access to the beaches in that area remains completely guaranteed.
The involved section is part of the 94 kilometers (58 miles) of the coastal road that connects San José del Cabo with La Ribera. Despite the legal situation, citizens can continue enjoying the beaches without restrictions, in accordance with current regulations. The City Council, together with the Cabildo, reaffirms its commitment to protect the rights of citizens and ensures that the resolutions taken are supported by legal documents that provide certainty. These decisions comply with current legislation and benefit the population.
The conflict affects only 3.9 kilometers (2.4 miles) of the road, which are not registered as roads in the municipal inventories or in the cadastral cartography.
This section is excluded due to decisions made more than 20 years ago related to tourism developments. Since 2006, an agreement between the State Government and the State Highway Board allowed the construction of a new route to replace that segment. This agreement was ratified in 2016, when the definitive disabling of the original road was established.
The City Council highlights that, despite the conflict, access to the beaches is assured. The new route built allows the traffic flow to continue without affecting the nearby communities.
To guarantee public access to the beaches, tourist developments must enable free and safe access, as a condition for their approval. In addition, since 2006, the construction of infrastructure such as beach parks with bathrooms, showers and recreational areas has been required.
The Cabildo is committed to constantly monitor that developments comply with these provisions, always prioritizing the well-being of the families.
